Practice focuses on patent, trademark, copyright and small business law, providing local counsel services, including Patent and Trademark Office, and Copyright Office liaison for many intellectual property attorneys throughout the world.

Representative Experience

• Successful defense to prevent the forced transfer of a domain name in Princeton Linear Associates Inc. v. Copland, 61 USPQ2d 1895 (NAF 2002)

• Expert Trademark witness for the successful defense in Petro Stopping Centers, LP v. James River Petroleum, Inc., 130 F.3d 88 (1997), cert. denied, U.S. Supreme Court, April 27, 1998. Also successful in related cases before the U.S Patent and Trademark Office Trademark Trial and Appeal Board. James River Petroleum Inc. v. Petro Stopping Centers L.P., 50 USPQ2d 1702(TTAB 1999) and James River Petroleum Inc. v. Petro Stopping Centers L.P., 57 USPQ2d 1249 (TTAB 2000).

• Successfully organized and executed the seizures and prosecution of a federal trademark anti-counterfeiting action in Philadelphia (The Game v. Beckers-Stewarts et al.) which resulted in the seizure of a significant amount of counterfeit merchandise and at least 10 permanent injunctions, and was instrumental in getting the counterfeit goods off the street.

• Served as an expert witness in the design patent and unfair competition case entitled What's What Incorporated v. The Butler Group, Inc., 90 CIV 3770(KC), in the United States District Court for the Southern District of New York.

• Serving as an expert witness for defendant in the trademark infringement and unfair competition case entitled WordPerfect Corporation v. Financial Services Marketing Corporation, CA 3-90-2729-R in the United States District Court for the Northern District of Texas, Dallas Division. Trial court decision for plaintiff was reversed, vacated and remanded to the trial court by the U.S. Court of Appeals for the 5th Circuit on April 15, 1996. Currently on Remand for the second time from the 5th Circuit.
