December 2011 Monthly Newsletter Amending an Association's Governing Documents Community associations derive substantially all of their authority and duties from their recorded restrictive covenants, bylaws and articles of incorporation ("governing documents"). Applicable law (e.g., the Condominium and Homeowner Association Acts) supplements and sometimes expands upon the rights and duties created by the governing documents, but the governing documents usually dictate how community associations operate. Thus, it is imperative that the governing documents remain current, consistent with evolving laws and help, rather than hinder, community governance and operations. As a result, we recommend that associations periodically review all of their governing documents and update the same as necessary. Please limit the number of representatives from a single association or management company to 2 individuals. We will try to accommodate everyone; however, we need to allocate space in a fair manner so that all who wish to can attend. Attendance is limited to the first 25 individuals who register.
